Special probation statute bill passed Assembly
On February 6, the New Jersey Assembly passed a bill that would expand the state's "special probation" law and allow certain drug addicted defendants to be sentenced to residential or non-residential treatment programs instead of lengthy prison terms. Sponsored by Assembly Majority Leader Bonnie Watson Coleman, Assembly Bill 1770 seeks to amend the special probation statute (N.J.S. 2C:35-14) and would apply to drug-addicted defendants who are convicted of drug related crimes carrying mandatory minimum or presumptive incarceration sentences.
The New Jersey Senate is considering Committee Substitute bill S-233 / S-504, which is identical to the bill passed in the Assembly. The bill must pass the Senate before it can take the next step toward becoming a new law.
